When you use this Site, or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this Site or through our other services. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirements that such communications be in writing.

Pricing and content

The Agency reserves the right to make modifications to the prices made public in the case of drastic changes in transport prices and other services.

The prices of our tours are listed in EUR – the official currency of Croatia.

Terms of Booking

Offered services are presented on our website with detailed descriptions and photographs. There are tabs with all program details including available dates and prices to be booked online. Additional information may be requested via email regarding any tourist services for which the company is registered.

All of our tours are held outdoors, and therefore affected by weather, traffic conditions, the situation on premises, and other unforeseen circumstances, and as such, the tour guides may adjust the itinerary to optimize your experience.

Methods and terms and conditions of payment:

  • The credit card will be charged for the total amount according to the terms and conditions as laid down in the accepted proposal.
  • We accept the following credit cards: MasterCard, Maestro and Visa
  • The credit card will be charged in Euros (EUR).
  • Your personal data, as well as your credit card details are fully protected. Data transfer is taking place on a secured server.
  • Refund to the credit card is granted per conditions below:
    • Refund can be requested within 1 day.
    • Refund will be done in the same way the payment was processed.
  • In case that credit card could not be charged, we reserve the right to cancel your order.

Statement on Protection and Collection of Personal Data and their Use

PISANKA C j.d.o.o. provides personal data protection by collecting only basic customer information necessary to meet business obligations. Collected customer personal data is kept strictly confidential and used only for the purposes for which it was collected. Access to the collected personal data is restricted to authorised employees only.

All employees of PISANKA C j.d.o.o. and business partners are obliged to demonstrate that their activities comply with the Data Protection Principles.

Statement of WSPay usage

Pisanka C j.d.o.o. uses WSPay for online payments.

WSPay is a secure system for online payments, real time credit and debit card payments, and other payment methods. WSPay ensures the customer and the merchant with the secure card data entry and transfer, which is also confirmed by the PCI DSS certificate that WSPay has. WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.

Statement about the Protection of Personal Data Transfer

Data protection pursuant to the General Data Protection Regulation of the European Parliament and the Council no. 2016/679- Regulation and implementation of the General Data Protection Regulation.

WSPay, being the processor of authorization and payment made by credit cards, uses personal data as the processor pursuant to the General Data Protection Regulation of the European Parliament and the Council no. 2016/679, and pursuant to the strict rules of PCI DSS L1 Regulation on protection of data entries and transfers.

WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.

Personal data used for authorization and collection purposes, or for performance of the contract or contract obligations, are deemed to be confidential data.

WSPay does not process or use these personal data except for the purpose of fulfilling the authorization and collection purposes.

WSPay ensures to meet all conditions determined by applicable personal data protection regulations, for the processors of personal data, especially by taking all necessary technical, organizational and security measures, which is confirmed by the PCI DSS Level 1 certificate.

Customer obligations and responsibilities

Customer must inform us in writing of any medical condition that requires attention or medication before your tour commences.

Customers are obligated to read information and advice about the tour they are participating in and to dress according to the weather conditions. The Agency denies any liability in this regard.

During the tour, your tour guide may take photographs and films of you (as part of a group) while you are a passenger and these may be used in our brochures, advertising and publicity material and/or social networks with Customers consent.

When booking online, Customer accepts all timetables presented online and arranged together with guides.

Agency can tolerate Customer delays up to 5 minutes without prior notice.

In case of delay for check in and registration for the tour that is more than 5 minutes, Agency in exceptional cases has right to cancel Customers booking.

In case of being late more than 5 minutes from the arranged departure point without contacting your tour guide or agency representative, Agency reserves the right to leave without those Customers who didn't show up.

In this case Customer does not have the right to any refund or cover any additional costs incurred by customer as a result.

Cancellation of travel

Any changes from the customer must be made by email to [email protected]. Reservation modification which made a change in the number of people or the date of the service must be made no later than 24 hours before date of departure.

Agency cancellation policy

Our tours itineraries are subject to change depending on group abilities and preferences but also weather conditions, water levels, other acts of God, special events of interest and similar. For Client’s safety and comfort reasons, the Agency reserves the right to alternate program without prior notice. In case of major changes or cancellations of a specific program booked by the Client, the Agency will advise the Client as soon as possible and provide the following options:

  • Client may accept a new departure date or destination
  • Client may accept a replacement package/excursion of equivalent or closely similar itinerary
  • Client may cancel his/her booking altogether

Extreme weather conditions

We reschedule the activity in case of extreme weather conditions, extraordinary circumstances, which could not have been foreseen or avoided, or have occurred immediately. The activity is then rescheduled for a day or two – either before or after the booked date.

Under no circumstances we can not be held responsible for weather conditions.

Insurance

During our trips your safety is our primary task. All our guides are always making sure everyone on the trip is well informed about all the safety procedures and they are always ready to answer all your questions regarding safety and help you in a case of need.

Your safety being number one priority to us means we are always doing everything possible for you to be able to enjoy your trip and relax completely. Of course, as in any other life situations there is always a possibility of things happening differently than planned. Therefore, all our trips without exception have injury insurance included in the price of the trip.

Complains and refund claims

Please contact your tour guide or representative immediately if the tour services are incomplete or executed below standard. We will consider the refund claims invalid unless the Agency was notified in a timely manner. Please send all refund claims to the agency via e-mail at [email protected]  within 7 days of the completion of the trip.

The Client is entitled to compensation in the amount of real value of services that have not been provided. All and any possible disputes shall be settled at a Split based court.

Court jurisdiction

This website is intended for use within the Republic of Croatia. By accessing this website you are agreeing that the Courts of Croatia will deal with any disputes which may arise between you and us, and that Croatian law shall be the applicable law.

The contents and formats on these websites, with the exception of the parts of text and pictures that have no commercial character and are exclusively meant for the purpose of guest information and the promotion of tourist services in Croatia, are owned by the Agency. The contents may be copied only for noncommercial purposes and for individual use, respecting all copyrights and owner’s rights.
